1. Introduction
Welcome to Swellcycle. By purchasing our products or using our services, you agree to the following Terms and Conditions. This agreement is between you (“Customer”) and Swellcycle, Inc. (“Swellcycle”), located at 2801 Mission St, Unit 233, Santa Cruz, CA 95060.
These Terms govern your purchase and use of our products and services.
2. Product Information
Swellcycle designs and produces sustainable, 3D-printed surfboards, surfboard cores, sculptures, and related products.
Detailed product descriptions, specifications, estimated timelines, and pricing are available on our website. Due to the custom and evolving nature of our technology, specifications may change without notice.
3. Orders and Payment
Order Process
Orders may be placed through our website or authorized partners.
Certain products are custom-made or manufactured after purchase.
Payment
We accept major credit/debit cards and other payment methods displayed at checkout.
Pricing
All prices are listed in USD and are subject to change without notice. The price confirmed at checkout is final for that transaction.
We reserve the right to cancel any order in the event of pricing errors or technical issues.
4. Shipping and Delivery
Shipping
Shipping costs and delivery timelines are calculated at checkout.
Delivery Estimates
Delivery dates are estimates only and are not guaranteed. Swellcycle is not responsible for delays caused by carriers, supply chain disruptions, weather, or events beyond our control.
International Shipping
Customers are responsible for customs duties, import taxes, and related fees.
Risk of Loss
Risk of loss transfers to the Customer upon delivery to the carrier (FOB shipping point), unless otherwise required by law.
5. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy available on our website.
Because many of our surfboards are custom or made-to-order, they are generally non-refundable once production has begun.
Customers are encouraged to review all product details carefully before purchasing.
6. Warranty
Limited Warranty
Swellcycle offers a limited two-year warranty covering manufacturing defects and material failures under normal use.
The warranty does not cover:

Improper storage (including heat exposure)

Modifications or third-party repairs
Warranty Claims
To submit a warranty claim, contact info@rideswellcycle.com with proof of purchase and photos of the issue.

7. Assumption of Risk
Surfing and ocean activities are inherently dangerous.
By purchasing and using Swellcycle products, you acknowledge and accept all risks associated with surfing and water sports activities, including risk of injury, property damage, or death.
You agree to use our products responsibly and in accordance with their intended purpose.
8. Limitation of Liability
To the fullest extent permitted by law, Swellcycle shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products.
Swellcycle’s total liability shall not exceed the amount paid for the product in question.
9. Privacy
Your use of our website and services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
10. Intellectual Property
All website content — including text, images, graphics, designs, and branding — is the property of Swellcycle or its partners and is protected by intellectual property laws.
Custom surfboard designs developed in collaboration with independent shapers remain the intellectual property of the respective shaper unless otherwise agreed in writing.
Unauthorized reproduction or distribution is prohibited.
11. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
12. Changes to Terms
Swellcycle reserves the right to update or modify these Terms at any time. Updates take effect upon posting to our website.
Continued use of our products or services constitutes acceptance of the revised Terms.
Swellcycle Surfboard Pre-Order and Reservation Agreement

These Terms & Conditions
These become effective on the date you place your payment (“Order Date”).
2. Agreement to Purchase or Reserve
You agree to purchase or reserve the surfboard (“Surfboard”) configured at the time of payment.
Pre-Orders secure a specific configuration.
Reservations secure a place in line for future configuration.
3. Price, Taxes, and Fees
Pre-Order Price
Prices listed during pre-order do not include taxes or official fees. These are calculated when full payment is due.
Reservation Fee
The reservation fee secures your place in line but does not fix the final price.
Final pricing is confirmed when converting to pre-order.
4. Cancellation & Changes
Pre-Order
You may cancel your pre-order before manufacturing begins and receive a full refund.
Once manufacturing begins, the order is non-cancelable.
Reservation
Reservations may be canceled at any time prior to conversion to pre-order for a full refund.
5. Delivery
Local Pickup
If picking up in Santa Cruz, you agree to take delivery within one week of notification.
Shipment
If shipped, Swellcycle coordinates shipment via third-party carrier at your expense.
Title and risk of loss transfer upon delivery to the carrier (FOB shipping point).
Delivery dates are estimates and not guaranteed.
6. Dispute Resolution & Arbitration
If a dispute arises, you agree to first contact Swellcycle at info@rideswellcycle.com.
If unresolved after 60 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be individual (not class-based).
You may opt out of arbitration within 30 days by mailing written notice to:

7. Limitation of Liability
Swellcycle shall not be liable for incidental, special, or consequential damages.
Your sole remedy is limited to reimbursement of your Pre-Order Payment or Reservation Fee where applicable.
8. No Resale; Cancellation
Swellcycle sells directly to end-consumers.
We reserve the right to cancel orders believed to be placed for resale or in bad faith.
9. Governing Law
This Agreement is governed by California law.
10. California Residents
If delivery is delayed more than 30 days beyond the estimated delivery date (unless caused by Customer), you may request cancellation and a refund.
